Terms of Service

Last updated: 27 September 2026

1. About these terms

These Terms of Service govern your use of Cambrian Hub CRM (“the Service”), a hosted customer-relationship and follow-up platform operated by Cambrian Hub (“we”, “us”). By accessing or using the Service you agree to these Terms. If you are using the Service on behalf of an organisation, you agree on its behalf and confirm you are authorised to do so.

The Service is provided either as part of a separate services engagement with us or under a subscription. Any commercial terms specific to your account — scope, fees, term — are set out in your order form, statement of work, or subscription agreement, which forms part of these Terms. Where that document and these Terms conflict, that document prevails.

2. The Service

The Service provides contact and pipeline management, calendar booking, quotes and invoices, forms, messaging, and AI agents that can respond to inbound enquiries across chat, SMS, WhatsApp, email, and voice. We host and operate the Service on cloud infrastructure on your behalf. Features available to your account depend on your plan and on which third-party integrations you have connected.

3. Accounts and access

Access is granted by invitation. The first user for an organisation is its account owner and controls who else is invited and at what role. You are responsible for keeping login credentials secure, for all activity under your accounts, and for promptly removing users who should no longer have access. Tell us immediately if you believe an account has been compromised.

4. Acceptable use

You agree not to use the Service to:

You are responsible for the conduct of your users and for the content you and they put into or send through the Service.

5. Your data and your responsibilities

As between you and us, you own the contact records, messages, documents, and other content you and your users enter into or generate through the Service (“Your Data”). You are the controller of Your Data. We process it only to provide and support the Service, in line with these Terms and our Privacy Policy.

You are responsible for having a lawful basis and any required consents for the personal data you load into the Service and for the outreach you carry out through it, for honouring opt-outs and do-not-contact requests, and for complying with the data-protection, electronic-communications, and consumer-protection laws that apply to you and to the people you contact.

6. Third-party services

The Service connects to third-party providers for functions such as authentication and database, application hosting, payments, email delivery, SMS and telephony, background job processing, AI models, voice calling, maps, website building, and social messaging. Some are connected using accounts you create and pay for directly.

WhatsApp via Meta is one such provider-side connection. Where you connect your own WhatsApp number through Meta’s Embedded Signup, that number and its WhatsApp Business Account remain yours and remain bound by Meta’s terms, including the WhatsApp Business Solution Terms and the Business Messaging Policy. Meta can restrict, suspend, or disconnect the number directly, and messaging through the number is billed by Meta to your own payment method. You authorise us to act as your Technology Provider for that connection: to exchange the signup token, register the number, send and receive messages on your instructions, and manage the connection while it is in place. Disconnecting removes our access; your WhatsApp Business Account and number stay with you.

Each provider is governed by its own terms, pricing, and availability, over which we have no control. We are not responsible for a provider’s cost, performance, downtime, suspension, or discontinuation, and a feature may be unavailable or reduced if the provider it depends on is not connected or is not functioning.

7. Fees

Fees, billing frequency, and payment terms are set out in your order form or subscription agreement. Unless stated otherwise, fees are exclusive of taxes, which you are responsible for. Fees for usage-based third-party services connected with your own provider accounts are billed to you by those providers directly.

8. Availability and support

We aim to keep the Service available and to resolve issues promptly, but we do not commit to a specific uptime level unless agreed in writing. We may carry out maintenance, and may make changes to features over time. Support is provided by email at support@cambrianhub.com.

9. Confidentiality

Each party may receive information from the other that is marked confidential or that a reasonable person would understand to be confidential. Each party will protect the other’s confidential information with reasonable care and use it only to perform under these Terms. This does not apply to information that is public through no fault of the receiving party, already known to it, independently developed, or lawfully received from a third party.

10. Disclaimer

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fit for your particular use case, or that it will produce any particular commercial result.

11. Limitation of liability

To the fullest extent permitted by law, neither party is liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Service. Our total aggregate liability for all claims arising out of or related to the Service will not exceed the fees you paid or owed to us for the Service in the twelve months before the event giving rise to the claim, or, if no fees were paid, one hundred United Arab Emirates dirhams (AED 100). Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Suspension and termination

We may suspend or limit access if your use poses a security or legal risk, materially disrupts the Service, or breaches Section 4, or if fees are overdue, and we will restore access once the issue is resolved. Either party may terminate for material breach that is not cured within 30 days of written notice, or as set out in your order form or subscription agreement.

On termination your right to use the Service ends. For 30 days after termination you may request an export of Your Data in a common format; after that period we may delete Your Data from active systems, subject to any longer retention required by law or by our backup cycle.

13. Changes to these terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date, and for material changes we will give reasonable advance notice to account owners. Continued use after the changes take effect is acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction, without prejudice to any exclusive jurisdiction clause in your order form or subscription agreement.
